Everview successfully defended an aggregate mining client against a frivolous unlawful detainer action brought by the mine site’s landowner. Everview assembled a team of the foremost mining and reclamation experts in California, and presented such a powerful defense that the landowner dismissed its case just days before jury trial was set to begin.

Everview represented a commercial real estate client in a dispute involving a non-paying tenant and secured recovery of possession of the property. Through effective litigation strategy and negotiation, Everview helped the client regain control of the asset and advance its redevelopment objectives.

Everview successfully defended a commercial development project against two parallel CEQA lawsuits and attempts to stall the project by preliminary injunction. Wins included denial of a motion for temporary restraining order, denial of motion for preliminary injunction, grant of two demurrers, and a final decision on the merits rejecting all of the petitioners’ claims.

Everview successfully defended a commercial-scale renewable energy developer against claims for property taxes related to a solar generation and battery storage project. Following extensive discovery and depositions, the plaintiff voluntarily dismissed its lawsuit on the eve of a jury trial.

Everview represented a residential development client in resolving alleged Coastal Act violations involving a project in Humboldt County. Through negotiations with the California Coastal Commission, Humboldt County, and regional Tribes, Everview achieved a settlement reducing proposed penalties by more than 90%.

Everview served as lead transaction counsel in negotiating and drafting a long-term lease for an international reclamation and landfill operator to establish an inert debris fill operation at a Southern California mine site. The transaction also included an amendment to the site reclamation plan expected to return more than 60 acres of disturbed land to developable pads and open space.
